At Piktochart, we believe privacy matters.

Piktochart is a product by Piktochart Sdn. Bhd. These Terms of Use relate to visitors to Piktochart.com (hereafter referred to as “Website”) and users of the Piktochart Editor (hereafter referred to as “Editor”):

  • Piktochart Visual found on Create.Piktochart.com
  • Piktochart Video found on Story.Piktochart.com.
  • Piktochart AI found on Ai.Piktochart.com

This includes you, dear reader. By visiting, remaining on this site, and using the Editor, you agree to our Terms of Use and all applicable laws and regulations.

If you do not agree with any of these terms, please do not access this site or use the Piktochart Editor. The materials contained on Piktochart’s website and its corresponding Piktochart Editor are protected by applicable copyright and trademark laws.

Use of Piktochart and the Piktochart Editor

Permission is granted to view and use the materials (information and software) found on Piktochart’s Website. This permission of use does not allow you to:

  • Modify or copy the materials in the Website and/or Editor, including any code, graphic assets, or text, except in the instance of visuals or videos customized and edited via the Editor in the account registered by yourself;
  • Use any part of Website and/or Editor for any commercial purpose or for any public display, commercial or non-commercial, except in the instance of visuals or videos customized and edited via the Editor in the account registered by yourself or where express written permission had previously been solicited and granted by Piktochart;
  • Attempt to decompile or reverse engineer any software contained on the Website or in the Editor;
  • Create materials in the Editor that have any of the following qualities: libelous, defamatory, pornographic, harassing, hateful, an invasion of privacy, obscene, abusive, illegal, racist, offensive, harmful to a minor or public, or an infringement of any intellectual property rights or trade secret of a third party;
  • Remove any copyright or other proprietary notation from the materials; 
  • Transfer the materials to another person or entity, or “mirror” the materials on any other server.

Piktochart reserves the right to remove content created using the Editor or uploaded assets that are found to be in breach of the permissions of use above or containing content that falls in any one or more of the categories below, with or without prior notice.

Such visuals and videos include content promoting any one or more of the following but are not limited to:

  • pornographic content
  • gambling activities
  • illegal activities (for example, distributing or making illegal firearms or weapons, illegal streaming, illegal downloading, and/or torrents)
  • selling of drugs that are illegal and/or without prescription
  • toxic or negative contents (for example, abusive, racist, derogatory, defamatory, profanity, sexual, self-harm, inciting conflict, offensive, hateful, and/or harassing)
  • content that may affect public safety, incite conflicts, and/or war
  • spamming of text on visuals (for black hat or other improper search engine optimization practices)
  • any propaganda, including politically or religiously motivated ones
  • provision of third-party services that can only be provided by the actual owner of the products and/or services advertised, unless otherwise authorized (for example, third party technical support)

Piktochart reserves the right to remove your content, with or without prior notice, at any time with immediate effect if you are found to violate any of these terms. Upon which, you should destroy any downloaded materials in your possession, whether in electronic or printed format.

Use of Piktochart AI

You can use Piktochart AI without the need to create or authenticate through a Piktochart account. However, to further customize, edit, download, share, and/or embed your infographic, you are required to authenticate to your Piktochart account in order to access the Piktochart Editor. Usage of the Piktochart Editor and its associated features are separately governed by the Terms stated in the previous section.

Your usage of Piktochart AI will be governed by a daily quota and per-minute rate limit for fair usage. Your access and usage of Piktochart AI may be restricted should the system detect that you have exceeded the defined daily quota and/or per-minute rate limit, or violate any of these Terms. Piktochart AI’s quota, limit, access, services, and availability are subject to change at Piktochart’s discretion at any time without prior notice.

Piktochart AI’s responses and generated content are moderated to ensure that it complies with Piktochart’s Terms of Use under the Use of Piktochart and the Piktochart Editor section. However, while Piktochart takes reasonable measures to ensure proper moderation within Piktochart AI, we cannot guarantee that all content generated will adhere to these standards. You can contact us if you find any generated content from Piktochart AI to be deemed inappropriate.

You are solely responsible for the text you type in to Piktochart AI, the resulting content generated by your input, subsequent edits in Piktochart Editor, and the infographic you download, share, and/or embed. You must ensure that your use complies with all applicable laws and does not infringe upon the rights of any third parties. Piktochart shall not be held accountable for any content generated by you and any other users using Piktochart AI. We do not endorse, verify, or guarantee the completeness, safety, accuracy, or appropriateness of any content created using Piktochart AI and they do not represent Piktochart’s view.

While we do not track or share any of your personal information, you are recommended to not input any sensitive, personal, private, confidential, and/or trade secret information while using Piktochart AI. Piktochart and our AI partner will not be held liable for any risks, losses, and/or damages as a consequence from using Piktochart AI in this manner. You can review our Privacy Policy on how we process, use, and share these information.

Termination

You are free to stop using the Editor and its functionalities (hereafter referred to as “Services”) at any time. We reserve the right to suspend or terminate your access to the Services with notice if:

(a) you are using the Services in a manner that would cause a real risk of harm or loss to other users or us, or

(b) you do not have a Paid Account and have not accessed our Services for 12 consecutive months.

We will provide you with reasonable advance notice via the email address associated with your account to remedy the activity that prompted us to contact you. We may also give you the opportunity to export your created content from our Services at our sole discretion. If, after such notice, you fail to take the steps we ask of you, we will terminate or suspend your access to the Services. Termination of access to the Services would also include all copies of your existing saved content and/or uploaded assets to be removed. They will no longer function as intended (e.g., embedded visuals will not load).

We will not provide notice before termination where:

(a) you are in breach of these Terms,

(b) doing so would cause us legal liability or compromise our ability to provide the Services to our other users, or

(c) we are prohibited from doing so by law.

Copyrights and trademark

Account owners retain the ownership as well as copyrights and intellectual property rights applicable to all materials uploaded to the Editor. This refers to images in JPEG and PNG, icons in SVG formats, as well as videos in MP4 and MOV formats.

Users can freely distribute content made using Piktochart on any medium, including TV, print, Internet, and mobile. Content created by users of a paid plan using Piktochart can be resold as an end product or a service provided.

Accounts created at Piktochart belong to the person who owns the email address used to register the account. Parents of any student that is using Piktochart can request for deletion of student data in their account.

Uploaded Materials

Account owners retain the ownership, copyrights, and intellectual property rights applicable to all materials uploaded to the Editor. 

Further to that, you are responsible for not uploading or publishing any materials (data, videos, images, and information) protected by copyright, trademark, or any other proprietary right without the expressed permission of the owner.

The account owner is solely liable for any damages resulting from the infringement of copyrights, trademarks, proprietary rights, or any other harm resulting from created material. In the case of Workspace, this is defined to refer to the individual assigned as the Account Owner. You agree to pay all royalties, fees, and any other monies owing to any person for any materials posted by you via Piktochart.

Subscription Terms, Fees & Payment

For the use of Piktochart’s complete suite of tools, themes, graphics, and features on the Editor, users are required to subscribe to a paid account. The subscription of which users are required to pay applicable fees as described on Piktochart’s Pricing page.

The payments are made to our online reseller Paddle.com Market Limited (hereafter referred to as “Paddle”). Paddle is the Merchant of Record for all our orders. By subscribing to one of the available plans, you agree to pay Piktochart Sdn. Bhd. through Paddle the subscription fees indicated for that plan. The fees described on Piktochart’s pricing page are exclusive of all taxes, levies, duties, or similar governmental assessments (collectively, “Taxes”) which are related to the sale. Paddle is responsible for the collection and remittance of the aforementioned Taxes.

All fees for recurring services are due before the beginning of the respective billing cycle. The billing cycle shall commence on the day you successfully start a subscription after paying the current fees, and end after one month (thirty days) for Monthly subscriptions, or one year (three hundred sixty-five days) for Yearly subscriptions, and automatically renew with the same billing cycle.

Any credits that may accrue to your Piktochart Account (for example, as a result of a referral program) will expire within two years following their accrual. Credits have no currency or exchange value, and are not transferable or refundable. Learn more about Piktochart Referral Program Terms here.

Upon each successful payment, your account will be immediately activated with the benefits as per the subscribed plan. For certain benefits of the subscription plans where monthly quotas are made available, any unused quotas shall expire at the end of the billing cycle and cannot be transferred to the next billing cycle unless explicitly mentioned otherwise. New quotas will be added to your account according to the subscription plans as soon as the current fees have been paid.

Should your account be in default, that is to say, that we were unable to receive payment for a particular billing cycle’s renewal, we will attempt to retry the charges to the registered card of the current subscription plan. With a continued failure to receive payment, Piktochart reserves the right to pause and/or cancel the current subscription, thereby reverting the account to a Free account as described on Piktochart’s pricing page.

Piktochart reserves the right to change this price list and institute new charges with adequate notice. Your continued use of the service means you accept all new or increased charges.

Cancellations and Refund Policy

You may cancel your paid subscription at any time. No notice period is required, and all recurring payments will be halted. Users will still have access to their plan up to the expiration date of their last payment.

Cancellation requests can be done on your Accounts Settings page on Piktochart or contact us here. We offer a money-back guarantee for paid subscriptions, which means we will refund you for any reason within 30 days from the payment date.

Avoid filing a chargeback through your bank separately or without going through us first, as that might incur unnecessary charges.

Health and Safety

Use of the information found on Piktochart and of the Editor is entirely at your own risk, for which we are not liable. It is your responsibility to ensure that any products, services, or information available through Piktochart meet your requirements.

Parents, teachers, and libraries are accountable for children under the age of 13 and their usage of Piktochart. We have done our part in complying with the Children’s Online Privacy Protection Act (COPPA) – view the “Piktochart and Children Under 13” section of Piktochart’s Privacy Policy.

You are responsible for compliance with any applicable local laws. Any claim relating to Piktochart’s website is governed by the laws of Malaysia without regard to its conflict of law provisions.

Disclaimer

Piktochart makes no guarantees, expressed or implied, concerning the accuracy, likely results, or reliability of the use of materials and information found on its Website, Editor, blog, or sites linked to Piktochart.

Piktochart does not endorse and has no control over user-created content. We cannot guarantee the authenticity of any data which users may publish via Piktochart.

Limitations

Piktochart is not liable for any loss or damages suffered in connection with the use of or exposure to any content contained on the Website or any user-created content published, emailed, accessed, transmitted, or otherwise made available via Piktochart.

In no event is Piktochart liable for any damages for loss of data, profit, or business interruption arising from the inability to use the materials on Piktochart, including the Editor and all user-created content. You will be solely responsible for any damages or loss to any party resulting from it.

Piktochart Free and paid accounts are designed to be used by a single user for each account created. Technical problems are likely to occur if more than one person uses an account at the same time. Therefore, we strongly recommend that you assign only one user per account to avoid complications that our support team may not be able to solve.

Persons wishing to collaborate on content may invite other users to join their Workspace if seats are available.

Free users have a limit of download credits per Workspace. To get more download credits, Free users must upgrade to one of the paid plans.

Revisions and errors

Information appearing on the Website and corresponding Editor could include technical, typographical, or photographic errors. While we strive to do so, Piktochart does not guarantee that any of these materials are accurate, complete, or current. Piktochart may make changes to the materials contained on its Website and Editor without prior notice. But we do not make any commitment to update these materials indefinitely.
